According to the report, NCB is not contesting the bail request, and assistant solicitor general S V Raju informed the bench of Justices AS Bopanna and MM Sundresh of this. However, the legal issue surrounding Section 27-A of the Narcotic Drugs and Psychotropic Substances Act should be left unresolved. Regarding Rhea Chakraborty’s case, the ASG pleaded with the court, saying, “Please keep it open for consideration. We are not contesting the grant of bail. Let the ruling not serve as a model for others.
After hearing from the ASG, the bench stated that it might not be necessary to challenge the contested order in terms of the grant of bail at this time. The judgement cannot be used as precedent in any other case because the legal issue discussed is left up to consideration in a relevant case.
“The allegations against the applicant of spending money to procure drugs for Sushant Singh Rajput will not, therefore, mean that she had financed illicit traffic,” the high court had previously stated.
After Sushant Singh Rajput passed away, Rhea Chakraborty was charged with aiding suicide and a complaint was made against her for allegedly buying medicines for the actor based on their discussions.
