Kamal Haasan recently went to the Madras High Court to protect his personality rights, objecting to the illegal use of his image, likeness and merchandising without consent.
The court recently issued its verdict allowing certain forms of creative expression like satire and caricature to continue.
The court noted that while celebrity images are sometimes used harmlessly for creative purposes, unauthorized commercial use or morphed images can damage their reputation.
It restrained the respondents from creating fake images of Kamal or selling merchandise with his name or likeness without permission. However it made it clear that caricatures, satire and other creative expressions are allowed.
John Doe was added as a second respondent and the court asked the plaintiff to publish the order in English and Tamil newspapers. The ruling is seen as positive, protecting actors’ rights while still allowing creative freedom.
